On October 17th, our Italian association APA, with the support of CEPI, organized a panel discussion in the MIA Market in Rome, on the transposition of the Copyright DSM Directive. The panel offered insightful presentations of the evolving national and European landscape regarding fair and proportionate remuneration, transparency, and contract adjustment mechanisms, in both France and in Germany.
Mathilde Fiquet, CEPI Secretary General, presented an overview of the Copyright Directive, highlighted that, while the Directive sets common principles across the EU, their transposition into national laws varies greatly. Each Member States tailors the details of the principles to align and fit in with their own cultural and negotiations practices. This leads to a broad diversity of solutions that each work within their respective national contexts.
Emmanuelle Mauger, Deputy Director General of the French Syndicat des Producteurs Independents (SPI) and Julian Waiblinger, Partner at Nordemann explored and detailed the national laws and interprofessional agreements in, respectively, France and Germany. They gave insights into the criteria used to determine the adequate and proportionate remuneration for authors and performers, the rules governing transparency obligations, as well as the contract adjustment mechanisms.
